This End User License Agreement (“Agreement”) is a legal agreement between you and Alyaka Game Studio (“we”, “us”, “our”), governing your use of our mobile applications (each, an “App”). By downloading or using an App, you agree to this Agreement.
1. Acknowledgement — agreement is with us, not Apple/Google
This Agreement is concluded between you and us only, and not with Apple Inc. or Google LLC. We, not Apple or Google, are solely responsible for the App and its content.
2. Scope of license
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on devices that you own or control, in accordance with the Apple App Store and Google Play usage rules. You may not copy, modify, reverse-engineer, distribute, or create derivative works of the App except as permitted by law.
3. Maintenance and support
We are solely responsible for providing any maintenance and support for the App. Apple and Google have no obligation to furnish any maintenance or support services.
4. Warranty
We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation. Except as expressly stated, the App is provided “as is” without warranties of any kind.
5. Product claims
We, not Apple or Google, are responsible for addressing any claims relating to the App, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to legal or regulatory requirements; and (c) claims arising under consumer protection or similar law.
6. Intellectual property
The App and all related intellectual property are owned by us or our licensors. In the event of a third-party claim that the App infringes intellectual property rights, we — not Apple or Google — are solely responsible for the investigation, defense, settlement, and discharge of such claim.
7. Legal compliance
You represent and warrant that you are not located in a country subject to a relevant government embargo, and that you are not listed on any government list of prohibited or restricted parties. You agree to comply with all applicable export and other laws.
8. User content
Content you create using the App (such as recordings, presets, and settings) belongs to you. We claim no ownership over your content.
9. Termination
This Agreement is effective until terminated. We may terminate it if you breach its terms. Upon termination, you must stop using the App and delete all copies.
10. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the App.
11. Age and capacity
You represent that you are at least the age of majority in your jurisdiction, or that you have the consent of a parent or legal guardian, and that you have the legal capacity to enter into this Agreement.
12. Severability
If any provision of this Agreement is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
13. Third-party beneficiary
You acknowledge and agree that Apple and Google, and their subsidiaries, are third-party beneficiaries of this Agreement, and that each will have the right (and is deemed to have accepted the right) to enforce this Agreement against you.

15. Governing law
This Agreement is governed by the laws of the Republic of Türkiye, without prejudice to mandatory consumer protection rules of your country of residence.
App-Specific Scope — Ad-Supported Apps
Advertising
Our Apps are supported by third-party advertising (Google AdMob / AdSense). By using an App you agree that ads may be displayed. On iOS, personalized advertising depends on your App Tracking Transparency choice.
Purchases
Our Apps may offer in-app purchases processed via Unity IAP and the platform stores (Apple App Store, Google Play). Payment is charged to your store account at confirmation of purchase. Refunds are handled by Apple or Google according to their policies. We do not process refunds directly.
